Mukhtar Ansari News: Giving a major blow to gangster-turned-politician Mukhtar Ansari, the police have registered a murder case against him. This case has been registered in connection with the 2001 ‘Usri Chatti’ gang war incident. Officials said on Sunday (January 22) that a case has been registered against Mukhtar Ansari under section 302 of the Indian Penal Code (IPC) at the Mohammadabad police station in Ghazipur.
Shailendra Rai, father of Manoj Rai, one of the victims killed in the Usri Chatti gang war, on Saturday filed a case against Mukhtar Ansari at the Mohammadabad police station after 22 years. The deceased Manoj Rai was a resident of Sagrao village of Rajpur police station in Buxar district of Bihar.
What is the whole matter?
In July 2001, the convoy of then Mau Sadar MLA Mukhtar Ansari was attacked near Usri Chatti on Yusufpur Kasimabad road in Ghazipur. During the encounter, a person named Manoj Rai died on the spot. One of the injured later succumbed to his injuries and nine others were injured. Five-time former MLA Mukhtar Ansari, 59, is currently lodged in Banda Jail in UP. He was brought to Banda Jail from a jail in Punjab on April 7 following the order of the Supreme Court.
Allahabad High Court also gave a blow
Earlier, on January 18, the Allahabad High Court had set aside the March 15 order of the Ghazipur MP/MLA court, allowing Ansari to be kept in a higher-class jail in Banda. This order was given by Justice DK Singh while accepting the petition filed by the state government. While giving the order, the court had said that the order of the special court was out of jurisdiction and gangster, dreaded criminal Bahubali Ansari was not legally entitled to a higher grade in jail.
State government opposed keeping him in superior jail
In the petition, the validity of the order of the special court MP / MLA court of Ghazipur was challenged, in which permission was given to keep Ansari in the Superior Jail. The state government had said that according to the UP Jail Manual 2022, the court only has the right to recommend superior class, but the final authority to accept or reject it rests only with the government.
The High Court has the right to send its recommendation to the State Government and the District Magistrate of the District Court. Under the jail manual, while providing this facility, the education of the prisoner under consideration, his conduct, nature of criminal incident and criminal intent will be seen.
Mukhtar Ansari has many criminal cases registered
The state government had said in the court, “Ansari has a long criminal history. He has 58 criminal cases against him. He is the kingpin of the gang and the crime is of a serious nature. A dreaded criminal cannot be given a higher grade.” .The subordinate court has exceeded the jurisdiction and directed to grant higher grade. The court has no jurisdiction to pass such an order.”
